Terms of service and conditions for the GOLD AVENUE affiliate program
Below are the terms of service and conditions for participation in the GOLD AVENUE affiliate program.
1. Affiliate URL
Affiliates will be issued a special URL once they become an approved member of the GOLD AVENUE Affiliate Program. This URL will be unique to each Affiliate.
2. Commissions
2.1 Affiliates will receive a twenty (20) percent commission of GOLD AVENUE’s gross margin on the metals sold to customers using GOLD AVENUE accounts created through properly coded affiliate links.
2.2 Commissions will be paid out for a maximum of 3 years after the account creation. We reserve the right to waive commissions at our discretion during a limited time or special promotions.
2.3 Commission rates are available at GOLD AVENUE’s discretion for select affiliates.
2.4 Word of mouth referrals will not result in an affiliate commission being generated.
2.5 Properly coded links are the sole responsibility of the affiliate.
3. Attribution
3.1 Each properly coded affiliate link grants a 30 days cookies on the user’s device.
3.2 In the case of a customer clicking on different affiliate links 30 days prior to his/her account creation, its affiliation is awarded to the last affiliate linked used by the customer following the last click model.
4. Payment
4.1 Commission payments are deposited on the Affiliate’s GOLD AVENUE Pay account 30 days after a purchase is made from one of his/her affiliated accounts.
4.2 The commission is calculated as a percentage of GOLD AVENUE’s gross margin on the products contained in the underlying transaction. It is converted using the daily spot rate used by GOLD AVENUE in the Affiliate’s account currency.
4.3 For a sale to generate a commission to an Affiliate, the customer must have had to remit full payment and, in case of shipment, must have properly received and accepted the goods.
4.4 Regarding data privacy, by entering into the agreement, the Affiliate is not granted the right to access any financial information for any transaction linked or not linked to his/her special URL. The only information available to the Affiliate is his/her commissions calculated by GOLD AVENUE based on his/her transactions.
5. Brand use and limitations
5.1 The Affiliate understands and acknowledges that this agreement is made between the Affiliate and GOLD AVENUE and is solely for the purpose of allowing the Affiliate to link to the GOLD AVENUE website in a clear and transparent manner for the user as to the nature of their affiliation to GOLD AVENUE.
5.2. The Affiliate receives a non-exclusive, non-transferable right, revocable at any time, to promote GOLD AVENUE through their unique affiliate link as defined in this agreement. The Affiliate can only use materials (including but not limited to logos, visual elements, texts, and other promotional and branding materials) which were directly provided and expressly approved by GOLD AVENUE for the purpose of advertising the GOLD AVENUE website.
5.3. This right shall only apply for the purpose of establishing links between the Affiliate’s website or channels and the website GOLD AVENUE. The Affiliate may not revise or modify the licensed materials in any way without the express consent of GOLD AVENUE.
5.4. As a condition to the Affiliate acceptance and participation in the Affiliate program, the Affiliate agrees to the following prohibitions:
The Affiliate may NOT:
engineer any website, social media channel or any other platform containing an Affiliate link in such a manner that pulls Internet traffic away from GOLD AVENUE;
make any representations, either express or implied, or create an appearance that a visitor to their website is visiting the GOLD AVENUE website, e.g., "framing" or "wrapping" the Site in any manner;
use GOLD AVENUE’s trademarks, including but not limited to brand name, website url, tagline, brand logo, in any manner not expressly authorized by this Agreement;
use GOLD AVENUE’s trademarks, or any variation or misspelling thereof, in metatags, hidden text or source code, in your domain name or any other part of your URL;
"scrape" or "spider" the GOLD AVENUE website or any other linked websites for content (such as images, logos or text);
place ads on, or participate in any way in, AdNetworks or Search Content Networks or similar services;
without the prior written approval of GOLD AVENUE, use any trademark, or any licensed material in an advertisement that is not created or provided by GOLD AVENUE in any way that might suggest or imply or mislead or is likely to mislead a visitor to your website into believing that GOLD AVENUE or any linked entities was the creator or sponsor of such advertisement;
bid on our GOLD AVENUE’s trademarks, including but not limited to brand name, website url, tagline, or any variations, at any website that provides search engine services whether it is to direct traffic to the GOLD AVENUE website through the Affiliate’s Affiliate link or to any website other than GOLD AVENUE’s;
engage in any direct or indirect relationships with ISPs and/or mobile carriers that results in the delivery or act of address bar keyword and URL error trafficking (e.g., a user mistypes a web address in the ISP's address bar or search bar, and, as a result, is redirected to a web page that contains a GOLD AVENUE Affiliate link that directs the user to the GOLD AVENUE website or any other website;
use any trademark, or any licensed materials, provided to the Affiliate as a result of their participation in the Affiliate program to advertise or engage in services which result in a sale occurring on the Affiliate’s website or channels, whether or not they then have the item fulfilled through the GOLD AVENUE website;
display any material on a website containing an affiliate link which contains viruses, Trojan horses, worms, time bombs, cancel bots or other similar harmful or deleterious programming routines;
post, publish, comment, link to or place their or any other Affiliate link on the GOLD AVENUE social media pages including but not limited to Facebook, Linkedin, Instagram, Twitter, TikTok, and YouTube;
release GOLD AVENUE features, advertisements or other information prior to their authorized release dates.
5.5. A breach of any clause in this agreement shall entitle GOLD AVENUE to terminate the contract without notice and retain all commissions present and future.
6. Qualifying Sites
GOLD AVENUE reserves the right to refuse any website entry into the GOLD AVENUE affiliate Program based on on-site content. Sites that do not qualify for the Affiliate Program include, but are not limited to, sites with content:
Promoting sexually explicit materials
Promoting unsafe behavior
Promoting violence
Promoting discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
Promoting illegal activities
7. GOLD AVENUE Anti-Spam Policy
7.1 GOLD AVENUE strictly prohibits Affiliates from using spam email and other forms of Internet abuse (including spamming forums, blogs, Twitter, Facebook, and other social media outlets) to seek sales. Spam is defined as including, but not limited to, the following:
Email messages addressed to a recipient with whom the sender does not have an existing business or personal relationship or is not sent at the request of, or with the express consent of, the recipient through an opt-in subscription;
Messages posted to Usenet, forums, Twitter, Facebook, and message boards that are off-topic (unrelated to the topic of discussion), cross-posted to unrelated newsgroups, posted in excessive volume, or posted against forum/message board rules. Affiliates should be conscious of forum rules. If a forum owner or moderator complains that an affiliate has spammed, the affiliate account may be permanently terminated after investigation.
Content posted on free blog websites for the sole purpose of keyword spamming or comments posted to legitimate blogs that violate the blog owner’s comment policy.
Solicitations posted to chat rooms, groups, or individuals via Internet Relay Chat or “Instant Messaging” system;
Certain off-line activities that, while not considered Spam, are similar in nature, including distributing flyers or leaflets on private property or where prohibited by applicable rules, regulations, or laws.

8. Relationship of Parties
Affiliates are independent, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties involved. Affiliates have no authority to make or accept any offers or representations on our behalf. Affiliates will not make any statement, whether on their sites or otherwise, that reasonably would contradict this statement.
9. Modification
GOLD AVENUE may modify any of the terms and conditions within this Agreement at any time and at its sole discretion. These modifications may include but are not limited to changes in the scope of available commissions, commission schedules, payment procedures, and Affiliate Program rules. If any of the modifications are unacceptable to an Affiliate, the Affiliate’s only recourse is to terminate this Agreement. If the Affiliate continues his/her participation in the program, it will be considered an acceptance of the change.
10. Term and Termination
10.1 The term of this Agreement shall begin as soon as the unique URL is transmitted by GOLD AVENUE to the Affiliate and will end when terminated by either party. Either GOLD AVENUE or the affiliate may terminate this Agreement at any time, with or without cause. Upon the termination of this Agreement for any reason, all licenses granted hereunder shall immediately terminate, and Affiliates will immediately cease use of, and remove from Affiliate’s Web Site, all links to the GOLD AVENUE websites, and all GOLD AVENUE trademarks and logos, other GOLD AVENUE marks and all other materials provided in connection with this program.
10.2 GOLD AVENUE reserves the right to withhold commission fees and cancel affiliation relationships without notice in case of compliance issues or unethical behaviors.
11. Limitation of Liability
GOLD AVENUE will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures, or data) arising in connection with this Agreement or the Program, even if GOLD AVENUE has been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to the affiliate under this Agreement.
12. Applicable Law and Jurisdiction
This Agreement shall be subject to and governed by Swiss substantive law. Any disputes arising out of, or in connection with, this Agreement, including disputes regarding its conclusion, binding effect, amendment, and termination, shall be resolved exclusively by the courts of Geneva, Canton of Geneva, Switzerland.
